BASIC TERMS

I know that many shooters don't bother with contracts. After all, most of the time, they aren't necessary.   However, occasionally problems do arise and it's good a idea to put our expectations in writing just to avoid misunderstandings. Having both hired shooters and having been one myself, I tried to write this agreement so that it's perfectly fair to both parties. As the producer you may wish to add or modify what I've written. I'm perfectly open to changes.

LETTER OF UNDERSTANDING

THIS IS A LETTER OF UNDERSTANDING BETWEEN DAN STRICKLER AND THE VIDEO PRODUCTION COMPANY.

BOOKING
A job will not be considered officially "booked" until Dan has the following information::
    a. The name of the client
    b. Date of event
    c. Times of event
    b. All locations

HOLDING A DATE
Dan will be happy to hold a date for a period of five days. If, during that period, another company offers Dan a job, he will give you the right of "first refusal".

THE FEE
Dan's fee is based on a 10 hour day. The 10 hours start with the "call time" and run continuously till the end of the event. For weddings, the call time is generally 1 hour prior to the ceremony.

HALF-DAY RATE: The half-day rate totals no more than five  hours, starting with the call time, Should the assignment exceed the five hours, the sixth hour will be an additional
$ ____ charge. Beyond the sixth hour, the contract shall convert to the full-day rate. This rate is intended for graduations, dance concerts, play coverage, sports, etc. It is NOT for Bar Mitzvahs which run five hours and more. They are charged at the full-day rate.

OVERTIME: Should the contracted time exceed 10 hours, Dan will be paid $____ for each additional hour.

GAS & MILEAGE: As long as the total travel, to and from the job, does not exceed 50 miles, there is no additional compensation. Beyond 50 miles, the production company will be charged an additional 45 cents per mile.

TRAVEL TIME: Some jobs may necessitate additional travel time due to traffic conditions. Generally speaking, if a job will require estimated travel beyond one hour in each direction, Dan will negotiate additional compensation prior to booking.

TOLLS AND PARKING FEES
Tolls and parking fees will be paid by the production company.

TAPE STOCK: The Production Company also agrees to reimburse Dan for all tape stock.

PAYMENT: Full payment is due to Dan upon receipt of the original camera masters.

DEPOSIT: The Production Company agrees to pay Dan a non-refundable deposit of $____________ in order to secure his services for the specified date.

EQUIPMENT SUPPLIED:   (Dan lists all equipment he will be bringing to the shoot. ) Any additional equipment shall be the responsibility of the Production Company.

SERVICES SPECIFIED: Dan agrees to make a good faith effort to follow a shot list provided by the Production Company. He also agrees to consult by phone with the Production Company and when requested, with the client, in order to better understand their needs.

FAILURE OF EQUIPMENT: In the event of equipment failure, Dan shall not be held libel for damages exceeding the amount of his/her fee.

ERRORS AND OMISSIONS: Should Dan either omit or through an error, fail to cover a portion of the event, he shall not be held libel for damages exceeding the amount of his fee.

DRIVING INSTRUCTIONS: The Production Company shall be responsible for providing Dan with complete and accurate driving instructions to all locations specified in the contract.

SCHEDULE OF EVENTS: The Production Company shall be responsible for providing Dan with a detailed  schedule of the events.

MEALS: If a meal is served to the guests at the event, Dan must be fed as well. If this is not possible, he must be told well in advance so that other arrangements can be made. In any event, when a meal is being served, Dan  will be entitled to a meal break.

WORK-MADE-FOR-HIRE: Dan Strickler's work on this project will be considered a "work-made-for-hire" as defined in the U.S. Copyright Act of 1976. As such, all rights to the materials videotaped are the property of the Production Company.

INSURANCE: Dan Strickler agrees to carry liability insurance amounting to $_______. He further agrees to furnish proof of coverage, should that be requested by the client or the management of a catering hall.

PROPER ATTIRE: Dan  agrees to dress appropriately, whether that requires formal, dress or casual wear.
